they believe we should cut our losses and shut it down. >> lets have a timeout on this, mr. president. you call a timeout on this. convene a group of bipartisan leaders to address health care concerns in this country because this is not working. bill: peter ducey is working today live in washington. how well is the website working? peter: is no longer a 1 24 hours per day website. it will be off-line at least from 1:00 a.m. until 5:00 a.m. every day. new members show consumers are not the only ones having problems with healthcare.gov. navigators who are there to make the process easier are turning away from the site as well. here's a quote from an octobe october 11 document. navigators are seeing people very frustrated and walking away so they are turning to paper applications to protect their reputations as people in the

community who can help even the paper applications will not have a quicker result, necessarily. the white house says they will fall short of their target enrollment for month one. >> i can promise you the first enrollment numbers released later this month are not going to be what we want them to be. no question about that. but we take responsibility for that, take response ability for the errors, take responsible before fixing it. if we get the website working by the end of the month, it will be in a good place. peter: demonstration said they had wanted just shy of 500,000 people enrolled by halloween, bill. bill: if the site is fixed on time, the end of november, just keeping track. is that enough time to satisfy republican lawmakers? what are they saying? peter: it depends on who you ask. ask. the senator rand paul says he thinks the government is just as big of a problem as the website.

>> government is inherently inept because they do not work in a profit motive. there is a certain safety net. national defense, roads, judiciary, and plus or minus if we should even fund congress. peter: the house committee chair rogers says cyber security concerns are so serious the site should be taken off-line until the administration can promise personal information will be saved. bill: now get back online. thank you, peter doocy. martha: number of obamacare enrollees is reportedly very low and somewhat a mystery as to how many of them are actually out there. open enrollment started october 1, so little over a full month now. he white house has not released any hard numbers on it. they say it will come in the middle of november. according to documents released by the oversight committee, only six people signed up on day one.

the next day it went up to 2.48 people. most of those people who signed up were not paying at all, they were enrolling in medicaid by huge numbers in terms of how out of whack that part of this is. stuart varney joins me now. stuart, these are nowhere near the numbers we heard were needed to make this solvent. stuart: that is precisely right, martha. you need the biggest pool possible with as much money as possible. that is why under obamacare everybody's got to have insurance, they want your money. if young, healthy people don't pay into this system, there's not much money going in. if a lot of older, sicker people go into the system, they're taking a lot of people out. if the young people don't front up and put real money into this system, they will be taking very little out, so insurers have to

raise their premiums, raise the cost of insurance they are offering so fewer people in role. that is the death spiral. things are not going well at this moment. martha: many people coming in are coming in from free care. they would have the best motivation to logon and try to get something. stuart: headline for the u.s. time says three for millions under the care act. including the medicaid people getting it totally free. that means the government has to be putting in, the taxpayer has a pudding and a lot more money because it is given away for free or huge subsidy. both sides of the fence not working. young, healthy people not in their money in.

it is just not workable. martha: if it has to be pushed somewhere, to be pushed onto insurance companies who would push on to the customer. stuart: exactly. which raises the premiums which means fewer people and roll. it is a vicious circle, it is not working. martha: boy, people were sputtering all over the place on this over the weekend on all of the sunday shows. a gasket blown across the networks and our conversation here. we will see where this goes. bill: trying to follow nothing with a flowchart. the stats on cancellations keep climbing. here are the cancellations across the country, seven states added to that list where tens of thousands of being notified insurance plan is being canceled. the number of people getting cancellation notice is now approaching 4 million.

almost 1 million people in the state of california alone. that number is expected to go higher. that number could get 12 million americans. martha: we have so much to go over on this today. we are learning so much about this program it. so many people running from it on all sides at this point. so what do you think? do you think the program should take a timeout? a lot of members suggested that would be a good idea. send us your thoughts on it. want to know what is on your mind and we will talk about it as we go through the show today. bill: the white house decision has been no delay, you can forget about it. martha: the more we learn about how they will put it together, the economic team said it should be outside business experts. the political team said no,

these folks in house have been on it since day one, they understand the program and are looking like the ones you have some explaining to do. bill: right on. ♪ new details now in a shooting rampage at lax on friday. one tsa agent dead, several others wounded including the gunman. investigators say the gunman, paul ciancia said he acted alone. the airport in los angeles, what else are we learning about this young suspects planned? reporter: bill, we learned he is pre-much acting alone. that is when he was arrested at terminal 3 behind me on friday. a disturbing plan that seemingly he only knew about because one of his remit stroked him to the airport to talk about a flight other than the suspects say he had one. they didn't know where he was going to anything at all. his roommate say h they had no

idea he would get out of the car and opened fire with intent on killing as many tsa agents as possible. as you might imagine, bill, right now the investigation continues to try to find out if there are any answers as to why or what sets this man off for you to bill: what is his status now? there were gruesome photos floating around the internet. >> he is in critical condition. he is sedated because he is trying to recover from his injuries. he was shot several times, in the phase as well, which is part of the reason why he has not spoken any longer to authorities. he is being watched very closely. as the investigation goes on, there is a lot of talk about the man who lost his life. they have those pillars here at lax, these art pillars out

front, they were blue over the weekend. more of a memorial inside as well, bill or you'd bill: adam, thank you. adam housley, lots of questions at los angeles today. 10 minutes past the hour. martha: this is a miracle in midair. two airplanes full of skydivers crashed into each other but the ending is nothing short of amazing. bill: also, this pregnant woman attacked in her home while a soldier watched in horror. how he captured the attacker. martha: during their darndest to defend the law as new questions emerge on whether top administration officials lied about the rollout. we will talk about that. >> before obamacare we were having-- >> will those people be able to keep their coverage?

martha: two planes collided in midair, and amazingly everybody survived. both of these planes were loaded with skydivers when they crashed early saturday morning. the passengers were preparing to jump at the time and were able to parachute to safety. one plane landed safely, the crashed to the ground. >> very, very lucky. anytime two planes collided in the air, it is a potential disaster for everybody involved. so we were all very, very lucky. martha: that is for sure. one of the pilots was hospitalized with minor injuries. nine others walked away virtually unscathed. the faa is now investigating. bill: unbelievable. a lot of blame for the website for this website rollout. health and human services secretary kathleen sebelius taken a lot of heat over this.

she is blaming the start date of october won on the law itself. watch from a few weeks ago. >> i think in an ideal world it would have been a lot more testing. we did not have the luxury of that. it is go time on october 1. bill: that was late october. here's a fact check of what she just said. the law says the enrollment period should be determined by the secretary. fox news digital politics editor, host of "power play" on foxnews.com. good morning to you. the first time i heard about it. what is the truth? >> what is funny is this is an administration that has been very choosy when it comes to which parts of the law they like in force in which parts of the law they don't like enforcing. most famously the decision to grant large employers a one-year delay in the time to have two provide insurance for their workers. they caught a lot of flack for

that. as for the october 1 date, she does have broad discretion as relates to that, but a new piece out in "washington post" today that sheds more light on why she decided to keep that day. that is politics were driving this far beyond policy up to and including the fact the technicians that were working on this absolute disaster of a website were hoping it would fail in a demonstration to the administration, so that officials would relent on this october 1 date and say they weren't ready for prime time, giving them more credibility. bill: when she said we had no luxury of that with the law that says it is go time october 1, is that true? or was that not true? >> no. she has broad latitude in this. broader latitude than in the decision not to penalize employers, their partners in the business community who asked for

a delay, the law was much more, had much less ambiguity as related to that favor the president did for allies in the business community. the fact the secretary decided to launch this, she would have much broader latitude. bill: was she lying when she said that? >> the l word. it is coming up a lot these days in washington about what is a lie, what is misleading, and i think in this case the law says october 1. the law says she has latitude about that. her characterization of it may have been overripe whether or not it is a lie, it is a something the writing of the law defends her reading of it, but it does not defend her emphasis. bill: this could be a question

on wednesday before that senate committee. david axelrod was on and was beaten up a little bit. take a look. >> why did not you wer or someby else they do him mr. president, don't say no matter what you will keep your health care plan. >> hindsight is 2020. >> that is why you are there. >> the vast majority of americans that statement will hold true for this small group of americans. the calamitous thing here is the website was up because many of those people who didn't get, have the transition will get better insurance for less money but they just can't tell. >> they just can't tell that? that is his phrase now. for this small group of americans which we intend could be 10 million or higher. is 10 million small to you? >> here's the thing, the president's team is in a shambles right now.

i had a prediction that would be this would be survivable. maybe it would have been if the website hadn't had also 10 skid the technical crash ended up being a lot more significant. axelrod, they're shifting the blame for their decision not to tell the american people, and here's what they did, bill, they didn't tell the president's priorities had changed. he previously prioritized if you like it, you can keep it. he then changed we want everybody to have assurance the way we say the habit. they made a political calculation. it is now crashing and burning because sebelius' team could not get the website ready. when you have a failure, this is inside the tank blaming each other. bill: i have 20 seconds for this. if republicans get their way and they get a delay in the individual mandate, is that a political victory? does the law fall apart? what happens?

>> premiums skyrocket and then we see what happens because if you delay this another year and the insurance industry is doing with new regulations and everybody is paying more for insurance, the train wreck gets worse, the fight becomes with what do you replace it, and that is when the republicans being bad at politics becomes much more consequential. bill: part of the reason why the white house says we're sticking with it. thank you, chris. out of washington today. martha: a pregnant women due to deliver any day was brutally attacked as her soldier husband watched half a world away. can you imagine how that soldiers wanted to action overseas. bill: a college student missing for two days has been found and he is alive stuck between a rock and a hard place. we will explain. >> i spent the last four hours until he was found walking the

bill: a college student here in new york missing for two days has been found, trapped between two buildings. according to reports, that student was stuck in this crawlspace for 36 hours. he apparently fell some 18 stories from the dorms roof into a gap that is only 18 inches wide. his friends alerted campus police after he went missing. >> had we not told security guards the three of us thinking-year-old students to check the roof, they would not have found him for who knows how long and he would probably be dead right now. bill: firefighters drilled

through the wall to get him out. he is now recovering at the hospital. what a weekend he has had. martha: a soldier serving overseas looks on as his pregnant wife is rudely attacked. can you imagine this? video chatting with her husband, justin, when she was attacked and stabbed multiple times. she was rushed to the hospital where doctors tried to save her and the baby's life. rick has the rest of this story this morning. this has been an awful sequence of events. >> absolutely, martha. she and her husband knew the guy, and justin took half a world away to catch the suspect who broke in through the back door and attacked rachel when she came home while she was basefacetiming with justin. she called 911 and her husband went online asking for friends to be on the lookout for the

19-year-old corey moss, fellow soldier in training captured when he was returned to base. doctors performed a cesarean section delivery a healthy baby girl named isabella and justin posted a message saying isabella has made a full recovery and no longer needs help breathing and eating. the blanket is a part of a set she sleeps with so she will be closed to mommy even though they have yet to meet in person because of rachel's injuries. rachel is still hospitalized in critical condition with stab wounds, fractures to her face and body and a collapsed lung. martha: what more do we know about this suspect? >> members say corey moss borrowed justin's car and damaged the vehicle. he went to the home to confront rachel over money he owed to fix it. police released a statement which reads in part, "we pride ourselves withi of soldiers witr

ranks. these actions are not representative of the men and women who serve. our immediate concern is the safety and welfare of the victim. where monitoring her condition and our thoughts and prayers are with her for a full and quick recovery. moss is being charged with attended murder and held at $60,000 bond." martha: what a way to begin a family life. we wish him well. bill: it has been more than three decades since the scene here unfolded. now iranian protesters are back in the u.s. embassy today with another message for america, they say, and a message for their home president. martha: the president's former opponent mitt romney has choice words for him over the broken obamacare promises. >> if you like your health care plan, you will be able to keep your health care plan. if you like your doctor, you will be able to keep your doctor. period. bill: there are tens of thousands in the streets of tehran earlier today. anti-american rallies in the capital city today also marks the 34th anniversary of the start of the hostage situation. amy kellogg covers this from london today. the heaviest demonstrations every year now, how was this one different? >> you know, bill, my first trip coincided with this

demonstration. i was literally taken from the airport in tehran the demonstration. we both started staring at me and finally one girl approached me and asked where i was from. i pointed the burning u.s. flag and she and her friends just first into smiles and said welcome to our country. not understanding the irony at all. in the past i would say these demonstrations would be full of students who sort of joined the street party, but this year according to journalists i have spoken with in iran and outside saying it took on a more political tone this year. it was better attended and there were lots of government officials and official personalities. many opposed to a possible warming of relations between the united states because i goes against what the public really stands for. maybe some they're not necessarily opposed to a warming of relations but not wanting others to take credit for it, bill.

bill: how does this fit in the context of the ongoing nuclear talks? reporter: bill, what i think is probably more significant was the speech given yesterday by iran's supreme leader who addressed students saying that the diplomats should not be harangued for their work in these negotiations. basically they shouldn't be stonewalled, they are not compromisers, so he was really giving indications he was backing this next round of nuclear negotiations which began on thursday in geneva. he did also say the u.s. was not to be trusted. these demonstrations which stem from that hostage taking, the dramatic 444 days for american diplomats really at the heart of why the united states still doesn't trust iran. all that has one iranian journalist saying there were tens of thousands out today, 30 million people in tehran. more significant is iranians

voted on a promise of improving relations to the rest of the world. bill: amy, thanks. amy kellogg there in london. martha: interesting developments yesterday when former republican presidential nominee mitt romney was speaking out about the presidents now disputed, that health care telling "meet the press" the deceptions could destroy the second term. here is mitt romney. >speak authenticating the president is trying to get away from, that is he told people they could keep their insurance and that was not the truth. whether you like the mile of obamacare or not, the fact the president sold it on the basis that was not true has undermined the foundation of his second term. martha: strong words. now secretary of state and the news editor at townhall.com and a fox news contributor. the question raised here really

is is this a moment, is this phrase, is this promise something that sticks so deeply in people's consciousness as they watch this whole thing that they never really get over it? >> i think it does. we are seeing millions of people. the administration wants to pass off 5% of americans losing their health care plans as just a few, but we have the millions after they were promised they could keep them. why this matters is because obamacare was supposed to cover people who are uninsured. it was not supposed to take away coverage for those who like the plan and taking fo personal responsibility. it draws attention to other issues not only in his second term but in his presidency about what else he has been saying and lying about as well. martha: you look back at other presidencies, the first president bush, read my lips, no new taxes, that never left him,

that phrase because taxes were raised. is this that kind of moment for president obama? >> not at all. the last person anybody will listen to about obamacare is mitt romney coming architect of obamacare and with president obama. he has his own credibility problems. martha: he is hardly the only person saying this. >> the fact is his plan is the reason we have obamacare. he chose to run for president in 2008. so in 2012 mitt romney rejected romneycare and the voters rejected him as president. martha: the fact is what does it mean to me now? i have got obamacare, promise i would not lose my doctor and lo and behold people are getting kicked off these plans all across america. how does this president turn it around? does he say i own this plan, it

is mine, come with me, i will pull you through this? >> two things, martha. that is exactly what he needs to do. what he should have said and what he needs to say now is you can keep your plan if you like it, or you are going to get a better plan with better benefits that cost less. and he needs to get out there and saw that and insurance companies need to be putting that in those letters because those are the facts, and that is what is going to happen. speaker that is the line many people are going with. it is a small number of people, so don't get so upset. >> millions of people losing their health care plans they like is a very big deal. for the president now to backtrack and not come out and say we were wrong, we knew people would be losing their insurance, we are sorry, this is what is going to happen. instead they are saying suck it up, now you can go onto the obamacare exchanges and people are now saying i was paying for

my own insurance, wasn't subsidized by the taxpayer and now i can't even get insurance through this program president obama claimed would be ready. it is dishonest and it will have a huge impact on 2014 but i agree with mitt romney on president obama's second term as a whole. martha: a look at this over the weekend, folks who are supporting this, they look exhausted. they look like they are so tired of having to do this. i know you have been a supporter of the plan. a lot of people were. they held reelect obama. but how do you feel about all of this now, really. >> 97% coverage, 65% of the people love it. but here the politics of this. the only thing working politically is the government shutdown.

that is going to cost republicans a lot of races tomorrow especially in virginia, i think people forgot all about the shutdown. what do you think? >> absolutely, the government shutdown is long gone. nobody remembers what happened with the government shutdown. this is all about obamacare of people getting a letter saying you are no longer covered even though barack obama promised to not once, not twice, but two dozen times you could keep your plan and people are not able to keep those plans. if people said we will take away your plan that you like and you have been paying for and give you a government plan even though you don't need it and you already have a plan that you like there is no way obamacare would have ever passed. massachusetts might like their health care plan but all of the polls show it and president obama not only his approval rating personally but

martha: it was a rocket first day of trial for outed egyptian president mohammed morsi. morsi told the court had no authority to put him on trial while outside a group of protesters and supporters tussled with the police. forcing the judge to adjourn the whole thing until january. there is that. >> the state department looking intlookinto what happened at be. they interviewed them. the number of who has explained the family are they being straight and honest with you about the obama administration. i shouldn't have to do this. i shouldn't have to make these kind of threats. they should provide an irresponsible way those who

lived in benghazi what happened to four, during after. bill: threatening to block the nomination of all nominees until congress is allowed to talk to the survivors of the attack in gaza. kt mcfarland now fox news national security analyst, nice to see you. he says i shouldn't have to do this to make these threats. why does he have to be? >> the administration will not let the survivors testify. why won't you let the survivors testify? if they don't get permission from the government to testify, these guys operate in the shadows, they go under pseudo names, they are cia contractors. if the government doesn't hire them, they don't have any jobs again. the government has to give them permission to testify before they do it.

bill: you say the real question to all this is what were we doing there? >> we already know this is a massive screwup. we didn't have enough security, we didn't rescue them, we haven't gone afte at the terrace after the fact. the one unanswered question throughout, what were they doing in the first place? you know what happens normally? they talk about lost luggage. these guys were security guys, former special ops guys. they weren't doing security checks for people getting their visas to come to america. what were they doing? in the shadows the rumors have been circulating what they were really doing was buying weapons that we had given the libyan rebels and they were taking those weapons to get them off the streets like a police commissioner would say would your guns, get them off the street or maybe what they were doing was taking those weapons

and filtering them to the syrian rebels. we don't know, that is just speculation. bill: why would it be so dangerous of that were proven true? >> the whole point of arming the syrian rebels, who are the syrian rebels? the majority of them and the strongest group were al qaeda. so you could take a step and say maybe what we were doing was taking weapons from rebels in libya and then funneling them to rebels in syria. bill: i always think about when hillary clinton was testifying and senator rand paul asked that question came out of the blue simile at the time toward the end of that hearing. will he end can he win off of this? >> depends. if all the republicans in the senate stick with graham and say we will withhold all nominations until we hear yes. but if the administration takes

away five senators,-- bill: adam housley strategy has to be republicans behind me, what is your sense of him achieving that? >> who knows. the administration will bring a lot of pressure to bear. will he? it is a hail mary pass. we can safely assume we will never hear from the survivors. bill: do you see the administration going on offense fell against anybody who does go? >> sure. there was a british guy writing a book and he was on "60 minutes" and the administration discredited him. they outed him. they leaked a memo with his name in it. saying what he said was different in the book and what he said when he was there. sort of a he said she said. they haven't the ability to destroy the livelihood. bill: i guess in time we will

know that. one would think. homeland security director, johnson, janet yellen the next leader of the fed. if lindsey graham was a successful on this maneuver and republicans get behind them, watch washington. martha: than the administration has to do something because government comes to a complete stop. bill: thank you. it is fascinating to watch and we will see if graham gets his way. martha: has the problem of bullying reached all the way to the nfl? why a miami dolphins player left the team and another player has been suspended indefinitely. bill: the defenders of obamacare out of wrath over the weekend after the architect of obamacare struggling to deflect blame for the rollout. that is next. >> those are companies making decisions on how they want to ensure people. because of the way obamacare

now the dolphins have suspended at least one player in this. live in miami. tell us about what is going on here. reporter: martha, this has dolphins fans scratching their heads. we were reporting on a bullying case, a 12-year-old middle school girl and now in this case they supposedly come is a 6'5", 320-pound offense of lyman, a starter with the miami dolphins. jonathan martin. he left practice a week ago after his fellow teammates refuse to eat lunch with him. this was the last straw in a string of bullying episodes. the miami dolphins suspended indefinitely another starting lineman. here is their statement. we believe and maintain a culture of respect for one another and as a result we believe this decision is in the best interest of the organization at this time. the dolphins have the next game monday night and are likely to be without two of their five starting lineman because of

this. martha: when you read some of the details of this case, you think you're looking at eighth graders based on some of what is going on here. this is a problem with the dolphins are bigger problem in the league? >> the two cases, 12-year-old and the footfall players, a lot of the same things play out. pictures back and forth. there has been a culture of hazing in the nfl among rookies. but he wasn't even a rookie, he was a second-year player. representatives say he was pressured to give $15,000 to senior players to finance a las vegas trip for them last summer and others have been posting pictures of a $30,000 dinner that the rookies were forced to pay for. martin himself with a stanford graduate, and there are accounts he has been bullied his entire two-year tenure with the dolphins. martha: very interesting story. we will talk about this later as

>> one of the problems lies at the core with what they're trying to do here and that is to insure the uninsured in numbers of the tens of millions of you can do that for nothing. and you need people to be buying in that are healthy in order to get the premium money rolling in that would be sufficient to cover the uninsured and allow older and sicker people. so by making these plans in terms of coverage and raising the price and so on, you bring that about, you bring in cash, this is always -- it was always at the core of this a certain amount of premium money to cover the uninsured and that is what led them to these decisions about what to include and so forth. you need to make the planned merger so they cost one you could collect more premiummoney.
